I signed a contract on March 14, 2004 for roof replacement, drywall repair, and other items. The drywall was damaged due to roof leake. The sheet rock were replaced but it was unsat done. This was done on or about the 21st of March. Today is May 6 and the drywall looks worse than before and no other work has been done on the roof. 55 days later. I want to cancel the contract by Monday if nothing occurs this week. Contractor says he has had a roof crew ready but they never showed up. I want my deposit returned totally since nothing has been done. THe contract stipulated on or about 30 days for completion time. I have been more than patient. Do I have a case against the company. I recently found out that this company has had complaints file against them with the BBB without resolve. Most of our contact has been through phone. Should I submit a letter giving him a completion date or else or should I just hand him a cancelation letter that depicts all the breaches of the contract. Thanks Rich
