My sister in Nebraska had signed a 3yr leasing contract under the influence of a pushy sales person for a
2000 Chevy S10 for $254.00/month a few months ago. The truck had 36 miles upon possession. During the two months she had the vehicle no payments were made due to insufficient funds. At the two month
mark she voluntarily returned the truck since her budget did not allow for this large payment. At the time of return the truck had 450 miles on it. Now the finance company is telling her she needs to pay $6000.00 to them. This represents the loss that the auto dealership says was
incurred because they had to auction off the truck. I'm wondering if she is responsible for this entire amount or just the two months she had possession of the vehicle? The finance company has not given her any other options. What are her legal rights?

Her legal rights depend on the terms of the contract she signed. Most finance contracts give the creditor the right to sell the vehicle upon non payment and apply the amount they get against the loan. She used the truck for 2 months and that made it a used vehicle and worth much less than when she took possession; therefore, the story sounds legitimate. However, have her check the terms of the contract to see if she has any rights.
