i purchased a car in april of this year. i put 5000.00 dollars as a down payment. 2 weeks ago the dealer called and told me they lost my check for 5000.00 and i need to replace it ASAP. Do I need to replace the check? what if i paid cash would i have to replace that too?

Did the check clear the bank? If not, yes, you are obligated to replace the check. I would place a stop payment on the other check and deduct the fee from the money you owe them. Do include a note that as they were the party that lost the check, it is only fair that they pay for the stop payment. If the check did clear, send them a copy with a note that they do have the money.
