Can a credit union in Texas repossess a car if the noteholder has been arrested, but not charged, for a crime? Can a co-signer assume the loan if the loan is not in arrears and take possession of the car? Police arrested our son on an erroneous tip that he had a methamphetamine lab at his house. He was in jail for 71 hours and then released on a personal recognizance. He has not been charged for any crimes. The credit union repossessed his car from the police impound, saying that if he were arrested again, the police could seize the car. His grandmother has co-signed on the car. They will not release the car to him or to her.

Read the contract your son signed when he bought the car. Any actions that could result in seizure of the vehicle is cause for immediate repossession. Many states have forfieture laws, if you kid is busted again, the police will seize the car and the credit union is out there money.
