What is the name of your state?utah
i cashed a cashiers chech through my bank, which guaranteed me the check was good. few days later bank vtells me the check was counterfiet and wants there money back. do i have to pay it back?

First thing is where did the check come from? Was it from a business? A friend? Relative? or what?

Being that it was your name on the check, then yes you are technically responsible for any action involved with that check. If you feel that it is unjustifiable and you wish not to be held responsible then you need to find where that check came from or who issued it and file a report with the police or most of all take it to court to have someone pay the costs of the counterfeit check as then most likely since the check was fake then charges can be held against the person responsible for issuing such a check.

But if you wish not to bring on legal action, then you best suck it up and pay the money back to avoid charges held against you by the bank you cashed it at. Don't wait to long to end up letting it get the best of you...

cashier check was issued by virgina bank 1, maryland, virgina. i imformed the bank of my situation and told them to hold the check for as long as neccesary for it to clear so there would be no problems. two bank employees told me the check was not only good but also was insured, and would be no problems in cashing the check.

Ok then if the bank who issued the check is so willingly to discuss the issue at hand with you and work with you, then why not make a conference call with you being on one end, the bank who issued the check, and the bank you cashed the check at and resolve it all together.

Maybe then you can set your mind at ease to learn and undertstand both parts to what is going on in regards to that check...And in the long run if either party is unwilling to cooperate, then I would enforce legal matters upon them in regards to the matter at hand.

Other than that...That is about the only options I foresee for you...Sounds like the communication is at least there and neither party has turned their backs on you...Now its just a matter of getting that check to clear and have the bank who issued you the check to either enforce the insurance from the check or pay out the amount owed for the check being cashed and any additional fees to be paid for what the bank requires in which you cashed it at...Sounds like its really out of your hands then and is an issue between the two banks...Since you know where it came from and all...You most likely WILL NOT be held accountable for the check as long as that bank who issued it is in business...They are responsible to put in their end of the bargain...

So, I would keep working on them and if something doesn't get resolved in a decent matter of time, then I would look into legal matters to get the issue resolved if they are still trying to harass you and try to make you pay for it...

i got check from someone who wanted to buy a 51 panhead i advertised through the internet, the bank knew all this before cashing check. now my bank has put my bank account into the negative and also put a hold on the cashier checks i bought from them to pay my bills off. can they do this?

That sounds remarkably similar to a new scam that's popped up. Here's the scenario. You put your '87 Ford Escort up for sale for $1500. A guy calls you about the ad and says "hey, that's just what I've been lookin' for, in fact I'll give you $1600. But, I'm not in your state (probably not even in this country) but I have a business associate that owes me $10,000 who will be passing through your state tomorrow with a cashier's check for $10,000. All you have to do is deposit the check, deduct the $1600 I owe you for the car and send me the remaining $8400."
Does that sound familiar? At any rate, you are ultimately responsible for the forged cashier's check. The bank is completely without fault.
And I'm almost certain that if I'm wrong about that, someone will be along directly to correct and maybe even chastise me.;)

i told the bank i don't have the money. they suggested i remorgage my house and ad what ever i owe to total of morgage,so as then i could pay them. istill don't know if i have to pay it back. what should i do?

Of course you have to pay it back. The bank is not at fault here -- your issue is with whomever gave you the fraudulent money order in the first place. You'll have to pay off the bank, then go after the other person for the money.

do i go after the the bank that issued the check? they where the ones that said the check was good and to cash it. "maryland,virgina,virgina one bank.

Is this an actual bank? If the check is counterfeit, then usually that means most information on it is also and the number you called could have been someones's sister that was a part of the scam. What you are talking about sounds more like a stop payment or possibly even a forged check.

First you need to know what you are dealing with. Second have you tried to contact the person that gave you the check? Once you know what happened to the check then see what reason might be behind it (if its got a stop pay on it). It's going to boil down to you and the purchaser as you have no guarantee from that bank that the check was guaranteed. A check can be fine today and have a stop pay put on it tomorrow. This sounds more like what you may be dealing with. Specific correct information will help you get specific correct answers.
