What is the name of your state? NC
Recently cancelled cell phone plan from AT&T.
At the time of signing-up, was not told that the phone required a one year contract. No literature was given stating that fact either. Was only given a general brochure of terms and conditions, which states that:
"The terms of this Agreement for each Number depends on the calling, data or Mobile Internet plan, feature or promotion you select and is described in a separate AT&T Wireless Calling Plan or Rate Plan Brochure ("Rate Plan")..."

I am being charged a $350 cancellation fee, which I feel is without merit, since I was not informed ahead of time, that the calling plan I selected required a 1yr term.

I would like to challenge this in small claims court.

Attornies, please advise on what you would do in this case.
