verbal contract with a consignment showroom,if I purchased a sofa from them, they would inturn take two pieces of furniture of mine for resale. I paid for the sofa in full and I have it in my home. They took my consignment and we filled out a paper contract that states: Unless otherwise agreed in writting, all items shall be accepted for consignment for a period of 120 days. items not sold after 30 days shall be marked down20%, after 90 days 50%. They took my furniture on1-20-03 and as of 2-10-03 their store had a fire. I recieved a phone call on 2-18-03 and was told that my fruniture was not burned in the fire, due to the fact that they had it in storage in another location (not being sold on a floor) I will have to take it back asap. I have no room.
Is this legal? The contract states "For sale, for 120 days" and it was never for sale. and it has been less than a month. If I must take it back, does everyone else? Can I find this info out.
