We entered into a software development contract with a county. The contract called for a 10% withholding paid at the end of the contract upon acceptance of the work. Two weeks before the work is complete, the County project manager decides to cancel the contract. He has withheld three months worth of services (about 100K), has about 110K of the 10% withholding, plus about 110K left on the contract. His claim for canceling the contract is that we did not finish the work on schedule as stipulated in the contract (but he let us keep working for two additional months before pulling the plug; two week before we were to present the final product. He is refusing to authorize payment for all monies due us. He claims he will need the mony to finish the work. Any recourse here?
