had contract with merchant account for business with authorization for them to remove money from business account. Had to close business account, but merchant account provider than removed money from personal account without authorization and also wanted to charge $5.00 a statement to service statements. had many harrassing calls from merchant account provider. merchant account in now sueing me in new york state and i live in california. is the unauthorized removal of funds, harrassing calls and excessive service fees a cross-defense for the breach of contract?
