What is the name of your state? WI

had started to install new bathtub ourselves (I know, we should probably get the stupid customer surcharge :) )

got all the pipes installed

had a leak but could not fix it, and hot/cold were backwards

tub was not yet installed and wall unit not yet cut to access shower head and faucet

called plumber, explained situation, he said he could fix our mistakes and finish the entire installation of the tub for 400.

they sent some 19/20 year old to do the work, we had all of the proper materials there (in excess) but this kid said he needed a certain elbow, so he went back to shop and got elbow, well elbow didn't work with all the other recommended pipes, so he decided to redo all the pipes, then he installed the tub and wall unit

there is now a 4 in gaping hole in the wall unit that he had cut for the shower head to come through, but he had piped the head up so high that it is above the wall unit (so this hole leads to nothing), and there is a whole in the drywall above the wall unit that is about 10 in long up to the head and there is a 6 inch gaping hole around the faucet, he did not caulk anything nor did he secure the wall panels, he also did not swap hot/cold. but he did say he would return the next day to finish.

he did not return, following monday called the plumber to remind them job unfinished, still did not send anyone out

folowing week called to talk to manager- on vacation left message with secretary explaining entire situation was told he will call when he comes back, never got a call

month later, get a bill for 480 from plumber

write letter explain everything (AGAIN) say that even though we had supplied all the necessary materials we understand he needs to cover his costs and sent him check for 80 the amount for parts indicated on the bill, but explain to him that the job is still unfinished and either they need to come finish or we will hire some one else. but until then will not pay for labor until finished.

they sent letter saying if we are trying to get out of bill after the fact that it will not work! The holes are still there! and we will have to replace part of the wall unit because of the holes and major repair to the drywall!

during the initial job they never asked for a signature to get the work done, even though on the carbon they mailed to us it does have an area for this and a disclaimer. but we never signed.

they just sent us another bill!

what are our options? do we have to pay for this shoddy work?

I was tempted to take the 400 and take out a big ad in the paper for them with digital pic of our tub  but I'm not that mean.

any help appreciated.

does anyone know, do we have to pay it at this point? is the plumber responsible for fixing the damage?
