Dell - Not Honoring Price after Confirmation and Shipment, Really need advice. thanks

hi, i was wondering if anyone can help me with my situation with Dell. i have contacted dell through emails and phone but to no avail. i emailed so many times that i think my email address has been blocked. i have spoken with as least 20 customer reps, case specialist managers and supervisors but none of them are resolving this issue.

I purchased a Dell 2405FPW 24 inch lcd monitor from their online Dell Outlet store for the sum of $428. The Order Acceptance and Order Confirmation emails stated that I ordered a 2405FPW for $428. However, after receiving the package and verifying the serial number with a Dell Customer Service Representative, I found out that the monitor was a 2005FPW 20 inch lcd monitor and not a 2405FPW. This is a huge discrepancy because there is a variance of 4 inches in monitor size and the 2005FPW does not have the 12-1 Universal Card Reader.

i ordered this on the 25th and have until tues to resolve this issue or else i am charged on my CC and cannot return it. After contacting dell so many times, i was given the go around CSR to CSR, CSR to technical support, etc and have gotten different reasons for my case:

1.) i was told by many CSR that there was a computer typo error on their website and a dell clause can waiver my case because of it. But i read their terms and conditions and it states "Dell is not responsible for pricing, typographical, or other errors, in any offer by Dell and reserves the right to cancel any orders resulting from such errors. "

this only gives right for dell to cancel my order am i correct? however, my order WAS NOT cancelled after it was placed. My CC was charged and product inferior to the one on the confirmation was shipped to my home. can dell do this?

2.) i was also given many responses saying - " when your order reached at processing stage we were short of 2405FPW monitors to process the
remaining orders and this is the reason your order was processed for next available 2005FPW monitor. Please be assured that we do not have any 2405FPW monitor left in our inventory."

I didn't know that companies can do this. If an item is out of stock, why would a different item be shipped? isn't this bait and switch? i know of case similiar to this going on in California where dell is being sued for it.

3.)
i got many responses saying - " In order to resolve your issue, I have thoroughly checked the database and show that 2005 FPW Monitor is listed on your order number . That is why; it has been shipped to you."

this is a complete lie on dell's part and contradicts every other excuse stated.


4.) when spoking with supervisors and case managers, they tell me that the marketing department sent out notices not to honor the price. They said the Promotion for this monitor is over and a 2405fpw cannot be sent to me.

funny thing is that, this case was brought up on another forum and many people (who ordered the same time as I) actually has gotten their 2005fpw replaced with a 2405fpw after many calls to dell. i told this to the reps and suggested to show them proof of their invoice and order number, but they told me they cannot look at other people's orders.

5.) lastly, i've gotten reasons that the 2405fpw is out of stock in their site. i tell them i checked just 2 minutes ago and there were 20 in stock. after being on hold, they tell me to go check now and i find out that the product was taken off their website. at tthis point i couldn't do anything and told them i would call back. two minutes after i hung up, i checked the website again and there were 20 back in stock. that just pissed me off, but i couldnt do anything


so i was wondernig if a company as big as dell can treat customers like this?
did they breach contract? this would have been a none issue if my order was cancelled instead of shipped. after they shipped it, im assuming the price was correct. even on the acceptance email i recieved, it states - "Lastly, the Order Confirmation e-mail will confirm your final purchase amount, pending any changes stemming from the verification of the online pricing of your order. " my order was verified and i was not contacted with no typo error on the site.

i really need some advice in this matter and any help would be appreciated .

have you notified your credit card company that you did not receive what was ordered and to not charge your card?

Have you asked Dell about returning the monitor you received? Have you taken it out of the box? What is Dell's return policy?

hi, thanks for the quick response.

i have not notified CC company becuase i really wanted the monitor for this price therefore i contacted dell first.

yes, they have offered to return the 2005fpw monitor and credit me back and told me to order a new 2405fpw at $1200. the fact of the matter is, i ordered a 2405fpw for $428 but they are not honoring it.

small claims

My understanding is that Dell settles claims like this quickly once you have filed a small claims suit. The same thing just happened to someone else I know of for a different product. He filed a small claims suit and it was settled. He's not allowed to talk about the settlement of course but I know he has the product he attempted to purchase.
