Disabled Person Wants to sue DELL.

What is the name of your state (only U.S. law)? California.

Hello, I am trying to get some opinions on what to do about suing DELL.
It all started when I ordered a brand new computer from Dell in February of 2008. It worked for the first 6 months and then it started going downhill from there. I called Customer and Technical, and also "Chatted" with them on Dell.com about getting someone to come fix the computer or to send a box out to me to send it in. After I don't know how many phone calls and Chatting's I decided enough is enough.
They will not give me a tech. They Say we have to troubleshoot it. I do not have the time to trouble shoot it. I have did what they told me to in the beginning, But now I just can't anymore. They called at 12:15 Am one time as a callback. A callback at 12:15 AM? Also the technical support people said different things to me. Almost all of them. I talked to one person and they Said It was DEFINITELY NOT a HARD DRIVE ISSUE, And another person says it is. I have wasted Plenty of hours and I mean plenty of hours on this stuff. And like I said before they always say "WE" can troubleshoot. WHOS WE? Not ME. It's not my job to do DELLS Job. I have lost many many hours and want to sue Dell. I am very unpleased with this company and will never be dealing with them EVER again.

Sorry I am so Frustrated but enough is enough. On top of that I have just been declared disabled and can not just concentrate on this stuff all day and need some opinions if I should Go forward with suing Dell. Thanks so much. What is the name of your state (only U.S. law)?

Dell isn't treating you any different because you're disabled, so why would your disability be an issue. If they are willing to troubleshoot the problem with you (as they would any other customer) then they are living up to their agreement.

At the end of the day, you can sue anybody, anytime, for anything if that is what you really want to do. It is probably going to be more of a headache than it is worth, and since you're disabled the task is going to be just that much harder.

I don't know why I included disabled but, I do know that they never once tried to send a tech out. They say trouble shoot first. Well we did. Now time to go to court. Also I read of a lawsuit where the people won against Dell for Calling them late at night. But they should be doing there jobs and not sitting back. Thanks for your quick reply.
