Can a bank waive your righty to overdraft protection services without your permission if you excessively overdraw your account despite always paying their overdraft fees? Does excessive overdrafts constitute as fraudulent activity? Can a bank close you account indefinitely because of this?

Absolutely yes.

It's in your account holder's agreement (contract). You know, those folded up papers that the bank sent you (or has online) but you never read.

Does excessive overdrafts constitute as fraudulent activity?
Could be fraudulent. Might not be fraudulent. Doesn't matter.

Can a bank close you account indefinitely because of this?
Yes.

Again, read the account holder's agreement.

not sure what you mean here. If you have a contract they provide overdraft protection, they would be bound by that contract. Whether they can, at some point, refuse to provide overdraft protection would be within that contract so, I suggest getting a copy of the contract and reading it.

it may or it may not; your intent is what matters here but regardless of whether it is fraud or lousy accounting, you are a liability to the bank and they can terminate your account due to the issue.

absolutely and they would be foolish not to.
