Unhappy Factory sucks me in for my breastpump.

What is the name of your state? South Carolina

Before I bought a used Medela breastpump for $400, I called Medela, gave them the serial number, and asked if it had been stolen. They said no, it had not been stolen. When I got the pump, it needed repairs, so I called Medela, gave them all the info, including the serial number, and shipped it to them for repair. They told me it would take two weeks.

Three weeks later I called and was told that it would not be returned to me because it was "Medela property". I asked what that meant and they said that that particular pump had been leased to a hospital and was reported as stolen. So, they won't give it back... They said that the pump was stolen and a collection account was set up for it. Their collection account was credited and the pump was returned to stock.

They refused to repsond when I inquired about my first two inquiries qwhen they assured me it was not stolen. They obviously lied to me until they had the pump and then stopped talking. This pump is several years old and has been through many hands-- can they stick me for the $400 after lying to me?

    Thanks.

Let me guess...You purchased this pump off of e-bay right?

And what did the police say when you took your documentation that you received from the factory to them?

Good call-- an EBAY deal. that's why I called Medena. I don't have the pump and am out the money and haven't gone to the police. Is that my only recourse-- go after the seller? I doubt they stole it. My beef is with Medena for not calling me off the sale to begin with.

    thanks again.

Do you have emails or some written record from the factory, stating it was not stolen?

Report to the police, let them figure out who stole it.
    Report to Ebay.

No such luck-- just the verbal assurance, twice, that it was not stolen. My first reaction is that this procedure is orchestrated by Medena to recover stolen property, which is effective, but deceptive and I would think, illegal.

There is nothing illegal about the factory's tactics. Nor would it be illegal for them to report you to your local police for receiving stolen property.

I suggest you put your pride in your back pocket and enlist their assistance in documenting the fact that the product was stolen so that you can file a police report and then send that to e-bay for their actions.

You need the factory AND e-bay to recover the seller's information.

And don't be surprised if you're screwed (no pun there ) in this deal.

O.K., I'll swallow my pride and probably eat the loss rather than get caught in the gears of the courts, but it sucks. No pun intended!

    Thanks for your sound advice.

Yes; you never had good title to the property to begin with. It doesn't matter what they say.

Thanks-- I have a kneejerk fear of simple legal stuff, but it's the best move. This is a great service and forum! Cyberspace at its best.

The FIRST thing we learn in law school is how to promote this fear among taxpayers.

So far, it seems to be working real good.
