Hi everybody!
Does enyone know who enforses the Fair Debt Collection Practices Act?
It looks like FTC is as useless, as they come. I informed the collection agency three times via fax and E-mail not to call me on the phone and they still do.
Any suggestions will be greatly appreciated. :)

You have to sue the violators in your county court. There are no government agencies that will act on your behalf.

Unfortunately, if you reread the FDCPA, you will see there is NO coverage for a limited Cease&Desist, the only one covered is a FULL C&D to cease all contact. If you send them that, and the debt is still in the SOL, you leave them no recourse but to sue you.

Some agencies do honor the limited, and don't call you, just to avoid the hassles, however, they ARE NOT required to do so.

If you want them to stop calling, you will have to send a full C&D and send it CMRRR, as proof the received it. They can always deny getting phone calls or faxes.

The limited C&D is an internet myth that has been perpetuated so much that everyone swears by it, but is just isn't real.
