Forgery by Employer on Nondisclosure Agreement

Left former employer - took similar position with competitor. Former employer has since accused former employee of using proprietary information at new firm...that's the background, which will be handled by new employer's attorney. New employer is in full support of new employee. However, former employer has created a credibility issue for employee at new employer, and is a definate distraction.

Former employer produced a copy of nondisclosure agreement. Employees signature is forged.

Employee has the original copy of signed nondisclosure agreement, provided to them when hired, but was never turned over to employer - document kept in employee's personal files, took personal files at time of resignation. The original document was not countersigned by former employer.

However, the document provided by former employer during current dispute is countersigned by them with a different date. The NDA presented by former employer is clearly a forged signature of the employee.

a) does employee have a separate case against the former employer for forging the NDA
b) does employee use the current employers attorney to represent the case
c) do any damages apply
d) does employee inform the current employer of the forgery
