What is the name of your state? Texas

I am about to pay off my car and at the time of purchase, there were no late fees charged, so the contract does not reflect them. Approximately three years into the contract, I received a letter from my financer notifying me of the new late charge policy. Due to circumstances, I have accrued some late fees that I must pay before they will issue the title.

Can they change the terms on the contract in this way?

Your contract probably has some clause that states you agree to the terms and conditions or policies of the agency and they are subject to change. It's pretty standard. Late fees are also pretty standard.
