My friend entered into a contract with a Cash Advance company for a paycheck loan. The company was receiving payments by making ACH withdrawals from her checking account. Her checking account was closed and she notified the company of this situation and asked for information on how she could settle her account via U.S. mail or some other way to pay. She was never sent any information and now they have filed a legal claim against her for breach of contract, stating that they were going to send the information to her local authorities at which time they could issue a warrant and charges of a Class C Misdemeanor could be impending unless payment is received by 2:00pmEST tomorrow 4/15/05. Is this information true? What steps can she take besides payment of the entire amount?

This has been in the news alot ..............dont be afraid it will be handled as a civil matter. Only a few judges have adhered to the full letter of the contract and they were found to be in cahoots with the shylocks.

But you have to fight it and show up with proof of everything. This is a loan and not a bad check charge.
