What is the name of your state? california, MY question is on a month to month rental contract if landlord is trying to serve you with an eviction and you try to contact your property manager but not available but you do get a hold of another land manager that works for the same company.If she tells you that she would wiave eviction notice and for the renter to go and pay the rent and the land manager accepts that payment and gives a receipt does the original property manager have to accept that agreement. Please help !!!!!!!!!!!

What is the reason for the eviction? Does this "landlord" work for the property management company or is it the property owner? If the landlord does not work for the management company, you could still be evicted even though the management accepted the rent payment.

the eviction is for late rent,and yes the land manager does work for the property manager.The land manager was contacted by the property manager to accept the rent,becausewhen giving the receipt she put on the it that property manager okay transaction

There appears to be some confusion or contradictions of parties in this thread.....
you have used the terms 'landlord', 'property manager' and now 'land manager' without any clarification of who/what.

Your post:

*** If the landlord (OWNER) is evicting you, the 'property manager' works for the owner, and is charged with the responsibilty of managing that property (and probably others). These are the ONLY two authorized parties for you to deal with. You then make mention of some 'company' without clarifying who they are and what the 'company' has to do with anything.
One other important (but overlooked) fact.... how was payment made?? Was it by check?? If so, the check can be returned to you and the 'transaction' reversed.... even if you have a 'receipt'.
And if by check, was the check good??

*** Now you refer to a 'she' (again without any clarification).

Bottom line.... it really doesn't matter whether someone without authority 'waived the notice', or accepted the rent, or gave a receipt..... none of that matters. You have a month-to-month lease. The landlord does not need a reason to give you a 30-day 'notice to terminate'. And the only outcome of this entire post is that you MIGHT have delayed your moving by one month. I would suggest that in the event that the 'notice to terminate' is waived due to your payment and acceptance, you take advantage of this and start looking for a new place TODAY.
