in texas, entered into a refinance loan to take advantage of lower rates. our mortgage company (out-of-town)worked all up with us over phone, airmailed new mortgage contracts to us and we signed with the agreed upon numbers in place. we received a letter from company stating that old mortgage was paid in full (by them in order to initiate new mortgage). closing dates kept getting pushed back, when finally they kept one the title company noted that the numbers we originally signed into agreement with did not match with what they were wanting from us at this point. my question is: this has been going on since May, we have a letter stating our old mortgage is paid in full, and the mortgage company cannot seem to get it together and make it right. they admit to messing things up - their fault. are we liable for any mortgage at this point since we have a paid in full on our original, and currently do not have a working mortgage in place??? morally, we know we owe money for the home, but just want to know is there any legal ground that we have?
