Paid the rent, getting evicted..

This is for a friend of mine.

She recieved a Notice of Eviction. Then tried to contact the land manager (out of town) so she spoke with the land manager's office. They said that if she paid up her rent with a Money Order, their attorney would dismiss the N.of Eviction.

She then paid with the M.O., got a reciept which was stamped "Eviction notice waived."

The owner then returned, gave the M.O. back to the Renter and said his office had no authority to make that arrangement without his consent and intends to go forward with the Eviction as planned.

My friend now has less notice to evict than when this all began and wants to know where she can properly appeal to have the eviction dismissed since she made good diligent effort to pay the rent as requested. Anyone know what office or agency can handle this on a local level? She has no money for a private attorney. Thanks.

The person at the land manager’s office was an agent of the land manager. Unless your friend had some sort of notice or knowledge that the person was not authorized to make such an arrangement, then the arrangement is binding on the land manager. If she can prove that the arrangement actually was made, she should win. She may be able to prove the arrangement by stating it then when the land manager argues against it, that would be an admission that the arrangement was made.
