payoff from being fired

What is the name of your state? Maryland

Was fired from large international shipping company for low sales quota. . . . (long story but EEOC was involved)

Nonetheless, the company offered a pay of $7,800 which they sent as is (no deductions such as taxes, etc).

Shortly thereafter they sent another $7,800 except they deducted monies for retirement, federal, state, taxes etc. and the net amount was $3,000.

Now they want the first $7,800 dollars back. The memo of agreement stated they would pay a flat $7,800 and did not mention deductions.

Should i consider this their mistake or do i actually have to return the full $7,800 or the $3,000? HELP!

If the agreement was to pay you $7,800 as compensation, they were required to withhold taxes on the amount. Therefore, the second payment was proper. The first payment was a mistake and you are liable to them to repay it.
