What is the name of your state? AZ My husband and I signed a contract with the couple who bought our house in Oklahoma; they borrowed $6,000.00 from us from the sale of the house. We signed a contract with them stating that they were to pay us $100.00 per month for 5 years; starting the 15th of February 2001. They have only been on time with their payment one time. We had a verbal agreement with this couple that when they sold their previous house, we would be paid in full. They have since sold their previous house, but told us that they had other bills to be paid and could not pay us off. Do we have any legal rights to the remainder of our money now or do we have to wait? Are they in breech of contract because we do not receive payment on time? Should we take them to small claims court or just hope that we will eventually get paid in full. To date, they have paid $2,300.00 and still owe us $3,700.
