What is the name of your state? ohio

i contracted in june 2002 to have hail damage repairs completed. as of today (3/26/03) work remains incomplete and paint materials have not been returned (by a subcontractor to the general contractor.) i have already had to have another contractor complete work that the general contractor said they could not do, but the work is listed in the contract agreement.

i received a summons today for breach of contract, and the contractor is attempting to collect "overhead and profit" of $1500. to date i have paid approximately $7000.

i now need to file an answer with the municipal court in order to dispute the claim. what information needs to be provided in my answer in order to be considered a valid filing?

My response:

No one here is going to teach you law and procedure. If you need to file an Answer to the Complaint, I would suggest you see a local attorney for help.

i am going to try defending myself. i have pictures of incomplete work and copies of all documents.

i am simply stating in my dispute that payment is being held pending completion of work, and plan to provide records in my defense.

if i do not engage an attorney what are the risks in defending myself. it seems fairly straight forward, so what am i missing.

My response:

You're "missing" the basic mechanics of legal knowledge. I understand that's why you came here, but in essence, you're asking us put you through law school and teach you the law, the procedures and Rules of Court.

To answer a complaint requires many, many facets of legal knowledge and intimate familiarity with your States' procedures and Court Rules. We can't do that for you, and it's only because of the fact that you don't understand the law is why you can't understand why we can't respond to you in the manner that you'd like. If you knew law, you'd understand my reasoning.
