I am a custom guitar builder and I recently subbed out a job to another builder. The guitars arrived at my shop 2 months late and out of spec. I contacted the builder a couple days after I received them with a long list of what was wrong. His response was, "Keep whatever you think you can make work, send back whatever you don't want. Pay me whatever you think is fair, or send them all back and I'll refund your deposit." After 2 more months of trying to determine how much time and effort it would take to bring them into spec, I told the builder that I want to return 9 of the 12 guitars. He's now refusing to accept them back and expects me to pay the balance. Am I responsible for the balance or does he need to accept them and give me a refund?
You sent him a long list of what was wrong , he made offers including return and refund .
You then did not communicate for two months trying to figure things out ( after the initial list was sent to him ) . Sounds like you already knew , did not take any action for two months .
Of course he expects payment .
While two months is not that long ,
What the court would decide is anyones guess .
