Ripped off by a jeweler


What is the name of your state?I am a resident of Wisconsin. About 4 months ago, I bought a new diamond wedding band from a local jeweler. I agreed to allow the jeweler to sell my old wedding band on consignment and I would collect a percentage of what he sold it for. This was to amount to $225.00 that he would owe me when my ring was sold. I didn't hear from him for about 2 and a half months, so I stopped by his store to speak with him. He was not there, but I spoke to one of his employees who told me that she remembered when we set up this consignment and that she knows that the ring was sold, but she didn't have any information in the store about it, so she would have to have the owner get back to us. She asked if we would leave our receipt for her so she could show the owner since she couldn't find any paperwork. We did (dumb move, I'm sure). The owner called back the next day saying that he did sell our ring and that he would send out a check right away. He said we would have it in a few days. About 2 weeks passed and my wife drove by his store only to find all of the windows covered. I immediately called the store and a message informed me that the store was closed and that they would reopen soon in a new location. I left a message for the owner and he called back. He again told me that I would have a check in a few days. I did not receive a check. I have now been calling for almost a month and he is not responding to my calls. The store has not reopened and I am starting to believe that it will not. I looked up his record on the public court records and it shows that he has been sued numerous times for money that he owed to people and didn't pay.

While this is a fairly small amount of money, this is a very frustrating situation. Is there any action that I can take to recoup this money?

That is what small claims court is for. In your case collecting a judgment could prove futile. I would chalk it up as a lesson learned.

I would also file a report at the Better Busines Bureau. They may or may not have any complaints as of yet.... But a step I wouod check into, will not help you recoup any money ut may help to get this persons business license taken or keep him from opening another. <shrug>
