February, 23, 2005 - owner of ladies only Fitness allowed me to have a ONE-WEEK trial for the amount of $1.00. Mr. owner told me in order to receive the one-week trial I would have to fill out paperwork he provided. He instructed me to “initial here, here, and sign’. I did what I was told and paid him one dollar. He was constantly on the phone, therefore I felt rushed and did not read what I signed - trusting Mr. owner that I was signing a one-week trial only. He even wrote ‘1 week trial’ before I signed. He never said anything about a contract. If the word ‘contract’ were spoken I would have run out of his facility. I never went in for my one-week trial. I thought, no harm done, I did not care for the dollar lost. I know I told Mr. owner in our conversation that I had to speak with my Husband before doing anything permanent.
March 14, 2005 – I receive a payment book and a membership card. Confused, I called Mr. owner and he THEN explained that I signed a one-year contract. I told him No, to my knowledge I did not sign a contract. He then instructed me that if I wanted to cancel, I had to contact his billing service. I did contact customer service department. They instructed me to submit a cancellation request via mail. March 15, 2005 I signed and mailed that request. April 16, 2005 – I received a letter stating that I had to pay $95.98 cancellation fee plus pay my account up to date. I have never used their services and after reading the document there is no statement about a cancellation fee required. It also states that I may cancel given a 30 day notice. I have already given my 30 day notice.
April 19, 2005 – I contacted Mr. owner to see if I could get this matter resolved. He stated that he could not cancel the contract - ever (the document does not state that it could NEVER be canceled) Mr. owner refuses to cancel. After trying to reason with him, trying to be polite as possible he would not come to an agreement of resolution.
April 20, 2005 - I get a letter from his 'payment service' and they are demanding the total of $499.55 immediatly or it is going to go to collections!
I feel that Mr. Owner was dishonest, and took advantage! I am very concerned that he will do this to someone else!
I have filed complaints with the BBB & with the Governor's Office Of Consumer Affairs.
Does anyone have advice to me on what else I should do?
