after living in our house only 8 months we began to have septic system problems. the builder initially agreed to pay for all the work and permits. the septic system is still having problems after 3 years of living in our house and we are still having the same problems. this will be the third time it has had to be fixed and now he tells us that we will have to get a lawyer before he will do anything else. the manufacturer tells us, it is either a installation or soil problem. please help!!

Then you should get a lawyer because he is not cooperating. Also, you may want to check the builder's agreement -- does it say the loser pays all attorneys fees?

If not, the court may award such because he is not showing good faith when you tried to work with him.
