What is the name of your state (only U.S. law)? Florida

I was sued by a Credit Card Company. I was able to get the case dismissed because the Credit Card company sued for breach of contract and failed to attach the contract to the complaint. Now they have sued me again under the theory of Unjust enrichment. Can the Statute of Frauds be utilized as a defense since the Unjust Enrichment argument is premised on the contractual agreement?
