sue owner or contractor

my electrical company in lewisville, texas did work for a contractor who is out of cooper, tx. the work was preformed in austin, texas. the contractor has disappeared, and the owner will not pay us because they have already paid the contractor. can we sue the owner or do we have to go thru the contractor.

Sue the contractor

Your contract, unfortunately, was with the contractor, not the owner; therefore, you would have to sue the contractor. It might be different if the owner had not paid the contractor, because that would probably be unjust enrichment, but that is not the case.
