Transmission Problem


What is the name of your state (only U.S. law)? Florida

Hello, I have a question.
A friend of mines transmission in her car went out, she got it fixed at a place ($1600) at cost cause she knew someone and without a warranty.
So, of course, it breaks. She takes it back, while shes telling them she has no money, they open it back up, it needs another $1600 worth of repair.
Of course she dosnt have the money, the car sits there the guy gets pissed, calls the bank of the car loan say its been abandoned for two weeks (when it was only there for about 1). Talk about getting a lean on the car making threats. After she wouldnt call him back (For 1 day), cause simply she has no money.
And, he says she has to pay storage fees now.
I feel so sorry for this person. Its turned into one big nightmare.
She still owes $2000 on the car. And her bank wont refinance the car for the repairs.
What should she do?
I feel that they are blowing up the problem, to cover the fact that they didnt fix her transmission right.

She should get her car back, bring it to another shop, get it fixed, get a statement from the second shop that the first repair was improperly done, and sue the first shop for the $1600 she paid them for the improper repair.

Yeah, thats what I told her. This guy is trying to charge her for opening the transmission back up and storage fees now, is that legitimate. Can he really do that to her, she did authorize to open it back up, but still. Could I get the police involved and go get the car back?

The police are going to say it's a civil matter, and refuse to get involved. I doubt they will release the car without being paid for whatever they demand.

She could sue now, but that would involve a lawyer, as a small claims court normally only lets you sue for monetary damages.
