Trash dumped in my drive way...


What is the name of your state (only U.S. law)? New Hampshire.
I had rented a dumpster from a large company for 12 years. Last Friday they came (while nobody was home) and dumped the rubbish all over my drive way then took the dumpster. Well water in use in my area. No letter or phone call before this happened. Is this legal?

Rubbish ,as in household food garbage ?

If it was food rubbish ,did you call your local Agencies to report the dump ?

Did you have a contract ?

Was your fees paid up ?

Yes, household rubbish since June. Packed down. It's disgusting.
Yes, called agencies and police to report this. Do you know of any particular agency I should call? It's a very small town and the police haven't responded to my calls or visits.
No contract.
Owed $300 but I have always paid on time or in advance for the 12 years.

So this is rubbish that has been sitting there since June?

So is it safe to assume that you haven't paid since June, and they haven't picked up the garbage since June?

And 5 months later they come to pick up their container after non-payment....and you have a complaint with them?

I have paid since June. The rubbish has not been picked up since June (it has a cover).

Ewww .. Call the health Dept . The Dept. of environmental conservation/protection . They have regulations on illegal dumping .

Call a rubbish company to come pick up the garbage, and sue the bad guy in court.

Rubbish is cleaned up but I have pictures. Do I just file a motion with the court for illegal dumping? Is it considered their trash if it's in their container? I think so.

You can sue in small claims court to recover your damages.

A charge of illegal dumping sounds like a criminal issue the police would handle. I'm sure you can file a complaint with the local police, but it sounds like you've already done that.

Note: If you cleaned up the garbage yourself, a court is not likely to give you much in the way of damages. The only real damage that would be recoverable would be the cost to pick up the garbage and put it into some other container.

What did they say when you called and told them trash (from the container) had been strewn all over your area? Did they deny it?

If the container had a lid... do you know how did the garbage got out?

I can't get a hold of the company. The container had a lid. The trash company came and dumped it on the drive way and took the dumpster.

Do you mean they emptied the container in your drive and took the empty container away? If you can't get ahold of the company, is there a chance they are no longer in business and someone took receivership of the equipment (including your dumpster)?

Yes, emptied it and took it away. On the spot.
Could be they went out of business. I'll check into that more. Thank you.
