My wife put money down and signed paperwork to hold a car. Two days later she called the dealership and told them she would be by to pick up the check because she didn't want the car. She was told that she signed a contract to buy the car. She was assured at the time of the signing that the documents were not binding and were only needed to hold the vehicle. The banks were not even open so she wasn't even approved for the loan at the time of the signing (the dealer did it the following day). Even the loan documentation looked like an just an application (she was a banker and is familiar with those documents).

A couple of other things...

The dealer lied about the vehicle not being a demo (it was - 790 miles) and made her sign a paper waiving her right to return the vehicle within 30 days. She signed it because, again she was told she could back out if she changed her mind anyway. Also we were told by an attorney (this is not her legal field) that because she was not compensated for the demo vehicle (no discount) that the waiver may be void.

Another way she can show she was decieved is that she is getting discounts from her grandfather who worked for GM. He was told that he may not be able to get the discount because he had reached his max for the year. My wife made it very clear that without those discounts we would never buy the vehicle.

The contract was signed on 8/5 and it is now the morning of the 8th. The vehicle is still at the dealership. By the way she put a stop payment on the check ($2,000) until this is straightened out. What reprocussions can that cause?
