What is the name of your state (only U.S. law)? Michigan
Looking at the Amazon kindle store terms, it seems to say that if they break the terms of service, they can never use the the kindle store again. Is this correct or does this just apply to the account?

Relevant terms.
Termination. Your rights under this Agreement will automatically terminate if you fail to comply with any term of this Agreement. In case of such termination, you must cease all use of the Service, and Amazon may immediately revoke your access to the Service without refund of any fees. Amazon's failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

Eh? The "YOU" and "YOUR" words in this agreement apply to the customer not Amazon. If you break the Kindle terms (i.e. you disseminate the copyrighted material beyond your personal Kindle, let's say), they will ban you from the service without refund. The second sentence says that just because they let you get away with it once, doesn't mean they're required to let you get away with it forever.
