my brother provided me with a promissor note on feb 25 2003...his wish was to purchase my 1/2 of my mom's house where her and i lived together until her death in oct 2002(my home of 43 years)....we are the only 2 heirs...i signed the deed transfer (deed) making him the owner in its entirety(trusting my brother)...i just accepted whatever he wanted to do ...the note states that he will pay me the agreed upon price at no interest upon the refinance or sale of my mom's house(which is not an issue because he wanted to live there anyway) , neither of which he is doing, but in any event no later than feb 25th 2004...he has decided to sell his former home on his own without a realtor in order to pay me..now communications have stopped ..we last spoke briefly in late april.. .i've phoned once, left a message and mailed him letters of goodwill but no response...he did deposit 10% of the money he owes me into an account in early april.,...i now live in NJ and the property is in NY...he evidently moved into the house sometime in june 2003...should i be doing something now or just waiting it out??.. .my stomach is churning
