I live in CA. A guy gave me a $1000.00 deposit to hold a car for two weeks. It has now been seven weeks and he hasn't paid the balance. Am I within my rights to keep a portion of the deposit since he did not fulfill his end of our agreement? There was no signed contract, only verbal. Thanks, Tim

I see the $1000 as payment to keep the offer open to him -- if he hasn't paid the rest of the money and has taken the car -- sue. If he hasn't taken the car -- keep the money.
