we recently had a verbal agreement to do sub contracting work for a builder. we explained at the time that the owner could not be on the job until he finished a commercial job he already had a signed contract on. we sent 4 workers to the job who we felt to be very capable of handeling the work. the builder had a dead line to meet and agreed. we submitted 4 estimates for 4 different jobs we would be doing for the builder. he paid us for the first job and paid us partial payment on the 2nd job. only to have one of workers who was leading the crew to take over the other 2 jobs and the 2nd one that was in progress. the builder paid our worker the remaining amount on the 2nd job which we had paid for all the material. the worker and the builder refuse to pay us the remaining amount that is owed on the 2nd job. our worker who received the money is also completing the other 2 jobs we had bid on . the builder had also agreed with us on our bid and told us we had the work. what is our next step?
