I live in Michigan where I was selling a tractor. During the negotiations his selling point was that he was able to give me the money in full that day. I accepted his offer under these condtions as my other offer could not pay for several weeks. Upon acceptance of a price of $7,300.00 he wrote me a check for $1,000.00 and said he would pay the difference 1-week later. This is unacceptable and goes against our agreement. I sent the original check back and expressed my opinion. He states he is suiing for breach of contract because I took consideration (deposit check) and we have a deal. Does he have a case?

this is a he said she said deal, the seller should have got it in writing for this amount of money, it would not be worth while for him to sue you because the legal fees would be greater than the sale price, tell him to pay the balance in full and he can have the merchandise and soon or you will seek another buyer. what's the problem it seem like he does not have the money for this purchase do not release the merchandise. if he returns be sure to take only a certified check or cash and if a bank check be sure it clears first. in the meantime look for another buyer.
