WA Contract to attend school

What is the name of your state (only U.S. law)? WA

My wife signed a contract to attend a makeup class in October. The contract states that tuition is due at the time of enrollment, but the instructor told her not to pay until 1 week before the classes start. The contract states that tuition is non-refundable. At the bottom of the contract is states "This contract is legally binding." The only way to hold a spot for this class is to sign the contract, which in effect makes you pay for the class. There was no deposit.

My wife now can't attend due to financial reasons. She contacted the instructor and was told that she signed a contract to attend and that she was stuck. Even thought the class isn't until October and the instructor advertises that there are only a few spots left, she won't let her cancel the class.

We haven't paid for the class, but are worried that she will sue us for breach of contract and we'll have to pay the class amount plus legal fees.

Any advice?
