I had puchased double pane windows of a particular kind from a company called Champion Windows (mfr). I came home during lunch and found they were not the windows that I had ordered.
The Sales Rep assured me that they could give me what I wanted. I gave a $3100 deposit based on his word.
I immediately stopped them and called the operations Manager to complain. After much debate he acknowledged that they made the error of not telling me that it may be a possibility they cannot give me what I want due to the type of frame in the house.
After 5 months of negotiating Champion Windows threatened to put a mechanics lean on the house if I didn't pay by June 3rd the following:
1. If they finish the project with the windows I didn't order I would have to pay the full amount of $9500 less the $3100 deposit ($6400).
2. Alternative would be that they would leave the project unfinished and would not give a warrantee, and, I would have to give them and additional $4400 by this Friday (June 3rd)
Note: Aside from not getting the windows that I had ordered, they cracked the picture window frame and the internal dry wall which now leaks. They had installed the patio doors wrong, a sliding window wrong, cracked the siding in various places and broke the patio light off the wall of the house.
Do I have any recourse?
