I am not sure this is the right category to post the question.
The question: if a company has a general confidentiality agreement, and an employee copies files without consent, what are the courses of action? employee has copied but has not used the files. employee copied files are in employer's possession. employee has agreed to delete files and to not use them.

What you are speaking of is less a copyright issue (although there may be elements of infringement) and more a contractual issue.

If you have violated the terms of your agreement by copying oonfidential documents or files, you risk not only your job but also you face whatever penalties are spelled out in the agreement.
