What is the name of your state (only U.S. law)? Massachusetts

I do a series on Youtube where I play through a video game (mostly games made in the 80's- early 90's) that has live audio commentary dubbed over as the audio. I want to release a DVD with this videos on them, but I'm not sure if I can. I've heard some people say that it is legal because I dubbed the game audio over with original audio commentary throughout the entire game, and that it is considered fair use. Is this true and would I be able to release a DVD?
