My biz is in CA.

If you find the exact product name you wish to use for your product name is already registered as a trademark in the uspto, is current, and in commerce, are you automatically prohibited from using this product name? My product is software and so is his, I'm in CA, he is in Germany. The software pertains to completely different fields of work. His is computers, mine is a tool for moviemaking.

The catch is, the name in question which I wish to name my product, IS the name of my profession.

Any advice?
