Hello,

I have an invention idea that is an improvement to an existing product. The basic product has been in existence for more than 20 years. There is a part to the product that is still under patent protection. If I use this part in describing my invention in the patent application, but do not include it in my claims, am I opening myself up to infringement? If it is possible to design
around this part, would that be a better option?

Can you infringe a patent in the patent application or only when the product is manufactured
and sold?
