Monograms

What is the name of your state (only U.S. law)? Oklahoma

1. If I use artwork from journals and magazines pre-1978, etc, can I create embroidery designs i.e. digitize for machine embroidery and paint on canvas, without worrying about copyright issues?

2. Can I use artwork, that is created and published for tracing, for digitizing for machine embroidery and painting on canvas for profit?
