We are student filmmakers making a documentary. One lady that we have included in our final film is now refusing to sign the release form. She doesn't have a problem w/what she said, she just doesn't want to be bothered and would rather we take her out.

We have her on tape in a group setting where someone announces what we're doing and no one gets up to leave. There are two cameras in the room and she raises her hand, stands and even looks directly into the camera. We have 2 quotes from her totalling about 20 sec.

If she doesn't sign the form and we use her footage anyway- does she have any legal recourse?

Any advice appreciated.

You can film anybody on the street and do whatever you want with the film. You don’t need a release form from the subject you filmed. This happens everyday on TV.

If she spent time sitting and she knew this is going to be a documentary, she cannot do anything after the fact, provided she is not minor. Based on the information you provided you do not need her signature on a release form or her approval to release the film.

If initially she was told that the film would not be release without her approval, then this is the term of the agreement. If there it no such an agreement, she can always file a lawsuit and seek a relief, whether she will prevails, no.
