What is the name of your state (only U.S. law)? New Mexico

If there is a name suchas joeschmoe that is TM'd
Could I TM joe schmoe???

So if two words are tgether can I TM those same words separated?

Thanks for your help!

P.S. Yes it is for an existing product, and no it is not really joe schmoe..

Two words put together will typically not receive a whole lot in the way of protection, and this is more true should the two words be very common words, as well if the words are related to the industry you are marketing in.

As far as slightly changing a mark in an attempt to make it a different mark, that usually will not work. One of the tests to determine trademark infringement is "likelihood of confusion", that is whether or not a reasonable person may be confused by the marks.
