Trademark and Exclusive distributor


What is the name of your state (only U.S. law)? FLORIDA

I have a 5 years agreement with a US distributor where he has the exclusivity to sell one of our products and we are now he wants to own a 20% of the trademark for the US.

Would we be able to change to a new distributor if he does not accomplish what is the agreement eventhough he owns 20% of the trademark?

Your post makes no sense. Try again in English. What do you mean he wants to now own 20%? You don't get things just by wanting it. The fact that he wants to do something also doesn't invalidate his existing contract with you for the exclusive distribution.

You're very right, that happens when you write back and forth and don't double check.

We agreed with our distributor the we may share the trademark. That might have been my first question: can a trademark be shared with multiple people, like an 80-20? But on the other hand, we have an agreement where he needs to accomplish certain objectives in exchage of an exclusivity, and if not, we can find a new distributor for our products. My question was again, would we be able to change to a new distributor eventhough he "owns" part of the trademark?

Does this make sense? Thanks!!!
