I live and own a shop in California.My friends and I started making a product just for fun and ourselves at home and now it has become something that we do in the store and we now make them to sell. Recently I found out that someone has a trademark on the goods and services. If the trademark owner wants to sue me does he first have to send me a "cease and desist" letter or can he just sue me right off the bat? Does anybody have any suggestions about how I can continue to sell this product?
