Another Bone in food


What is the name of your state? WI
Yes..you've heard it before, but....I had a 1.5" chunk of bone in a chicken sandwich, did an accident report, got a sorry, can we have the bone, umm....2 days later I get a call from there insurance company asking what I want to "end" the claim. I was told to ask for $3000, in otherwords..sell the bone back to them, they would loose alot more if this gets out. Sure its greedy...but my child chokes on it it would be way worse, maybe they need better suppliers. lay it on me...fast food lottery...

As IAAL inferred, was there a point to the story? Were you looking for something in particular?

You mentioned no injury and the bone is not a foreign object so take what you can get and run. Yes, the bone could have been dangerous but it apparently wasn't in your situation.

You are correct in your assumption that the restaraunt could lose much more if publicized. Does this mean you are willing to extort more money by threatening to sue? If so, who would be the bad guy in that situation?

Dude- I did not see reference to a physical injury....btw Wisconsin does not recognize "negligent infliction of emotion distress" as a separate tort.

It sounds to me like the insurance co. is offering $$$ without the OP having to do anything.

I guess it was just food for thought! how can a bone not be "a foreign object " in a boneless sandwich... yes Im cashing in...yes I talked to a lawyer, just wanted to see what others would do.

the insurance company called me...wanted to know what I wanted to settle, thats when I called around and was told I couldn't sue for this and that and what to ask for to keep it hush hush. Im not greedy and not looking to get rich. But hell, if they want to pay me for there MISTAKE, im cashing in, the family is going on vacation.

let me turn this around once..if you had a 1.5 inch bone the shape of a spear in your mouth/sandwich.....would you expect somthing other then a "sorry, can i have the bone, here, talk to the 20 year old shift super"

It's not a foreign object because chickens are born with bones. It is a always a possibility that a piece of bone may be found in a "boneless" chicken sandwich. Just like finding a cherry pit in a cherry pie.

Now if you found a piece of glass, rock, screw or even a beef bone, that would be a horse of a different color, green!!

its not foreign to the chicken itself, but it is to the sandwich, you dont expect it to be there.
